There are many regulations that can be written ambiguously and thus be understood, but in this case the initial situation is quite clear: according to ASTRA: brakes - 2, on separate wheels (at least 1 of which is a friction brake *) and the * with 1 stands for the friction brake, which is actually operated regardless of the battery status. In Article 178, point 4, it is also mentioned: In the case of multi-track motorbikes, the wheels of one axle must be braked simultaneously and evenly, unless each wheel of the axle has its own actuating device and alone provides the braking effect prescribed for both brakes together in a track-following manner. In this case, a brake on the second axle is not necessary. This also means: one could "actually" do without the electronic brake completely, but since the requirement is for 2 - one has installed an electronic one here simply to save on the costs of a "further" physical cable braking.
