The discussion is divided into three parts: The first part examines the fundamentals of the aforementioned saying. The second part deals with the legal position of the creditor. It centers on the rights granted to him by civil law to avert a looming loss. The third part is dedicated to the protection of the debtor, highlighting how substantive law enables him to free himself from a ruinous obligation.
