The acquired rights appear as a remnant of past times in our legal system. The notion that certain valuable positions of private individuals can claim an almost absolute protection against the state is questioned by scholars. However, acquired rights are present both in current legislation - in the Water Rights Act and the Water Protection Act - as well as in case law. Legal application must engage with them. The investigation has two objectives.
