For more than 20 years, the European Union has been attempting to introduce a European private law for all member states. With the Common European Sales Law (CESL), the European Commission presented a proposal for an optional sales law on October 11, 2011. This aims to unify contract law across Europe and promote trade within the European Union. This work examines the case of rescission due to deterioration or loss. It addresses problems and interpretational difficulties through a comparison with the Civil Code. In this context, the regulations on risk-bearing and compensation for value are considered.
