About the work
This textbook systematically presents the entire field of contract law from the ex ante perspective of Kautelar jurisprudence. A methodological section explains the elements into which the three basic contractual types - exchange contracts, gratuitous contracts and partnership agreements - are divided and how the drafting of contracts builds on this to modify statutory contract types and develop its own types. The handling of mandatory contract law is explained as well as the different contract phases (initiation, conclusion, execution), each with its own legal contract action programme. The largest part of the textbook deals with the drafting of exchange contracts, exemplified by purchase, rental, work and service contracts, among others: How do you draft the typical contractual performance and monetary payment? How do you regulate the fulfilment of the contract and avoid advance performance risks? How do you make private pension provisions against performance disruptions, defects in effectiveness and contractual loopholes? Other sections provide an overview of gratuitous contracts and partnership agreements, the drafting of contracts in family and inheritance law as well as cross-sectional areas, such as the drafting of contracts in international situations or involving public authorities.
