Versammlungsfreiheitsgesetz Berlin (VersFG BE)

On February 28, 2021, the Freedom of Assembly Act Berlin (VersFG BE) came into force. A fundamental prerequisite for this was the Federalism Reform I, which removed the right to assembly from the competing legislative competence of the federal government and transferred it to the states. With this commentary, the authors provide practical and scientifically grounded assistance for the application of the new fundamental rights guarantee and danger prevention law. They particularly focus on a constitutionally compliant interpretation of the provisions, taking into account the high importance of freedom of assembly for the democratic rule of law.
