There is a contradiction in valuation between Art. 210 para. 4 OR and Art. 199 OR. It would be contradictory in terms of valuation if, according to Art. 210 para. 4 OR, the limitation period for new goods in consumer sales cannot be less than two years and for used goods not less than one year, while at the same time, the buyer's warranty claims in consumer sales could be excluded through Art. 199 OR. Therefore, this dissertation interprets the existing contradiction in valuation between Art. 210 para. 4 OR and Art. 199 OR within the framework of legal methodology. It can be anticipated that, based on the interpretation of this contradiction in valuation, the warranty claims in consumer sales have a mandatory nature by law. This interpretative result leads to questions that have not yet been addressed by doctrine and jurisprudence and opens up the possibility of interpreting various legal issues in consumer sales through a new interpretative lens.
