Product details
Globalization has changed the state and its institutions, and the relationship between direct democracy and international law is now experienced as more conflictual than at the beginning of the 21st century. Migration movements raise new questions about minority protection and coexistence, and the adequate protection of communication freedoms and privacy presents us with various challenges in the age of Big Data, fake news, and artificial intelligence. What do all these changes mean for the constitutional law of Switzerland as a fundamental and framework order? Twenty years after the new federal constitution came into effect on January 1, 2000, this collaborative work by professors of constitutional law teaching at Swiss universities conducts a fundamental review of Swiss constitutional law. The authors do not comment on individual constitutional articles but focus on thematic reflections organized into manageable reading units. The contributions aim to stimulate thought and place questions of constitutional law within a broader historical and cultural context. The international dimension is included, as is the constitutional law at the cantonal and municipal levels. Additionally, the comparative legal perspective allows for a fresh examination of Swiss peculiarities. The work seeks not only to provide answers but also to raise forward-looking new questions.
