The legal regulations on matrimonial property law, maintenance and pension equalization in Germany, Austria and Switzerland are presented, as well as the possibilities of agreement within the framework of a marriage contract or marriage pact and a divorce agreement. After comparing the three legal systems, the advantages and disadvantages of the regulations and case law are discussed. Furthermore, the harmonization of family law at the European level is discussed. The jurisdiction of the courts and the applicable law are pointed out. Finally, the creation of uniform conflict-of-law rules and a standardization of the consequences of divorce are discussed.
