Product details

The demarcation between permissible legal invention against the clear wording of the law and proscribed norm correction has been controversial since time immemorial. In recent times, the so-called teleological reduction has been at the center of the discussion. What this argumentation figure, borrowed from German doctrine, is all about and how the methodological understanding behind it relates to the approach prevailing in Swiss law, in particular to the correction of the commandment according to Art. 2 Para. 2 CC, is explained in detail in the present work. At the same time, in the course of the study, the preconditions and limits of the finding of law contra verba legis are made visible and illustrated by means of numerous examples, whereby the concluding overview allows the reader quick access to the problematic points of interest.
