Legal certainty for building projects in Styria. The Styrian Building Act 1995 (Stmk BauG) forms the central legal basis for building projects in the federal state of Styria. It regulates the necessary authorisation procedures for new buildings, extensions, conversions and changes in the use of building structures and includes building police measures such as removal orders, bans on use, construction stops and sealing. Apart from certain statutory exceptions that require authorisation under other legislation, for example in road or waste law, the Stmk BauG is the relevant legal basis for most construction measures. It also contains provisions on administrative penalties, which provide for sanctions for deviating from legal obligations. This commentary brings together important legislative materials - government bills, committee reports and explanatory notes - as well as landmark decisions by the Administrative and Constitutional Courts. The aim is to provide those applying the law with a comprehensive and practice-orientated insight. The authors, all experienced lawyers in public building, regional planning and municipal law, enrich the commentary with their expertise from their professional practice.
