Group delinquency, organized crime, terrorism – collective crime has many faces. Criminal law addresses the collaboration of actors primarily through general rules regarding perpetration and participation. In addition, the legislator has established a system of offenses related to gangs, organizations, and associations, for which collective behavior is constitutive: participation in a gang, a criminal organization, or an unlawful association is required. This work deals with this participatory behavior and the peculiar attribution structure of these "collective offenses." It engages in a dialogue with empirical sciences regarding human behavior in groups and develops statements on the scope of collective offenses that are applicable across different offenses and can facilitate a coherent interpretation of the individual offenses.
