Ratzel:Commentary on the (model) professional code

The work comments on the model professional code, which is the professional law for physicians in Germany. The new edition incorporates the changes decided by the 125th German Medical Assembly.

The professional code for physicians remains relevant even after the amendments to the Civil Code (treatment contract) and the Criminal Code (corruption in healthcare), as these norms pursue partly different regulatory objectives. Furthermore, professional law is also adapting to new developments such as digitalization (keyword: remote treatment). The ruling of the Federal Constitutional Court on assisted dying continues to concern the medical profession. In professional law, the relevant provision §16 has been amended. The influence of non-professional investors (private equity) on healthcare facilities is growing dynamically. Professional law must address this development. The commentary develops solutions for this.
