Voice assistants and artificial intelligence have become an integral part of modern life and the marketing of many companies. An important criterion of a networked world is that not only the user, but also the products are increasingly intelligent. Voice assistants are at the centre of this "smart living". From a legal perspective, the emergence of an increasingly autonomous machine assistant raises numerous questions. Among other things, it must be clarified to whom the actions of the voice assistant must be attributed and who is liable if damage is caused to a third party through the conscious or unconscious actions of the voice assistant. Furthermore, it must be illuminated to whom the content that the voice assistant may create is to be attributed. Data protection law, of increased relevance and much discussed since the introduction of the GDPR, must also not be neglected in a data-centric environment such as the use of voice assistants in particular and the concept of smart living in general.

"Virtual Assistants. A Legal Analysis de lege lata and de lege ferenda": Virtual assistants and artificial intelligence have become indispensable. An important criterion of a connected world is that not only the user but also the products are 'smart'. Legally, it must be clarified who is liable for damages caused by virtual assistants and to whom the content created by the virtual assistant is to be attributed. Data protection law must also not be neglected in a data-centric environment, as the use of virtual assistants in particular and the concept of smart living in general entails.
