Sekundärrechtsschutz und Schadensersatz im Vergaberecht

The aim of this work is to present the currently most important issues related to secondary legal protection in public procurement law. In particular, it addresses the question of the constitutionality of the division of procurement law and the resulting necessity for a reorganization of procurement law. Based on a comprehensive evaluation of European and national regulations and case law, the author concludes that only by creating an independent procurement law and a specialized legal basis for claims can a lawful system of secondary legal protection that is fair to all parties be achieved. The book is aimed both at public contracting authorities, who should be made aware of typical evaluation errors, and at bidders and applicants as well as their lawyers, who should be equipped with the tools for effectively asserting their rights.
