Schwengel:Besondere Eigenschaften legis

The subject of this work is central problem areas of the self-organization law of the Bundestag and Bundesrat. According to common understanding, the rules of procedure of the Bundestag are considered internal law, subject to discontinuity, and are characterized particularly by their flexibility in allowing deviations in individual cases. The author critically questions whether these supposed characteristics, in their absoluteness, correspond to the real conditions of the parliamentary process. The focus of this work is on examining the prerequisites and limits of the authority to deviate. At the same time, the often-overlooked internal procedural law of the Bundesrat is thoroughly analyzed to determine whether the characteristics of the Bundestag's rules of procedure can be transferred to the Bundesrat, in order to identify common features of legislative procedural law.
