This analysis of joint wills, inheritance contracts, and other agreements concerning death in German, Austrian, French, and Swiss law explores how, within trust relationships, such more or less binding agreements regarding a testamentary act can be reconciled with protection against excessive self-commitment and unilateral enforcement of interests. The complexities and need for reform of the inheritance contract under the Swiss Civil Code primarily concern Swiss practitioners and authorities. Additionally, the author, due to her multinational studies, presents a perspective on joint wills and inheritance contracts that transcends national borders, which will be of interest to both practitioners and European institutions in a comparative legal context and regarding the interpretation of the EU Succession Regulation.
