Besondere Verfahrensarten: Überlastung der Strafjustiz oder Ausdruck erhöhter Punitivit

This work deals with the special procedural types of criminal procedure law, namely the penal order procedure and the abbreviated procedure. The penal order procedure and the abbreviated procedure are analyzed from their historical development and examined for their compatibility with the principles of procedure and the requirements of the European Convention on Human Rights (ECHR). In light of the increasing significance of these procedural types, the question of the underlying reasons for this development is then explored. To this end, the thesis of the expansion of criminal law and its impact on criminal justice, as well as the development of punitiveness, are investigated.
