Joint custody should become the norm in future divorces. The Federal Council aims to establish the foundation for ensuring that children have optimal conditions even after their parents separate, through this revision of the Civil Code. The divorce of parents is undeniably a complex process, which does not hinder the involvement of children; rather, it necessitates it even more. There is significant skepticism and uncertainty on both the authorities' and parents' sides regarding whether and how children can and should be involved in the family's reorganization process before, during, and after the divorce. The last revision of divorce law in 2000 aimed, among other things, to substantially improve the position of children affected by divorce. The procedural institution of child hearings was legally established.
