Rücknahme der Lizenzbereitschaftserklärung nach § 23 VII PatG

The dissertation encourages a rethinking of the current licensing of patents and aims to promote the utilization of the numerous granted patents that are currently unused. To this end, it highlights the shortcomings of the seemingly attractive but rarely utilized declaration of willingness to license under § 23 of the Patent Act, whose original goal of simplifying and reducing the costs of patent exploitation is currently failing. In comparison to Chinese and British law, it formulates targeted legislative changes that are intended to allow the public to use patented inventions during the twenty-year patent term in exchange for a reasonable compensation determined by the DPMA.
