AI systems, especially for voice and video analysis, are increasingly being used in personnel selection. The aim is to identify suitable applicants and optimise the recruitment process. The study analyses data protection and anti-discrimination issues. The author analyses the extent to which insights into the personality and emotions of applicants are permissible. He also discusses the conditions under which automated decisions in the recruitment process are legitimate and the extent to which AI systems must be made transparent. Potential discrimination by AI systems is addressed and the coverage of such cases by the AGG is analysed. Questions of fault and the attribution of fault are also considered. An outlook on the effects of the planned AI regulation on the use of such AI systems rounds off the study. The author concludes that AI systems can improve the recruitment process.

Privacy and anti-discrimination issues are highlighted. The first part examines the extent to which insights into the personality and emotions of applicants are possible and automated decisions are legally permissible in the recruitment process within the scope of the GDPR. The second part addresses potential discrimination by AI systems and analyses the coverage of such cases by the GETA.
