Personal and factual independence is one of the cornerstones of courts under the rule of law. Nevertheless, judicial decisions do not arise in a vacuum. Courts and their judges are involved in a complex network of relationships with numerous interactions - institutional and functional, in the actual proceedings and beyond. Judicial decision-making is influenced by, and in turn affects, various actors from society, the media, politics, administration, and jurisprudence.
The contributions to this conference volume document the results of the 58th Assistant Conference on Public Law in Regensburg 2018. Young scholars from the entire German-speaking region sound out the possibilities and opportunities, but also the legal limits, of such interrelationships from different methodological and sectoral perspectives. They thus draw a novel picture of the conditions of judicial lawmaking in public law.
