On July 1, 2010, the Federal Act on Product Safety (PrSG) came into force. It aligns the legal situation in Switzerland with international standards. The PrSG, together with the Product Liability Act (PrHG) and the revised Federal Act on Technical Barriers to Trade (THG), forms a cohesive unit that collectively enhances the level of protection in Switzerland. The PrSG establishes various obligations for manufacturers, importers, and retailers. They are only allowed to market products that do not pose a risk to the safety and health of users and third parties, or only pose a minimal risk, under normal or reasonably foreseeable use. The obligations of those who market products do not end with the introduction of the product. Article 8 of the PrSG imposes a series of extensive post-market obligations on them as well. The PrSG raises numerous questions. The authors of this volume addressed these questions at the conference on Product Safety and Product Liability - New Challenges for Swiss Companies held on March 31, 2011, in Lucerne.
