This brochure describes the employer's obligations, the responsibility for the fulfilment of employer obligations, the transfer of employer obligations and the consequences of non-compliance with employer obligations. To shorten the tedious search for the legal texts mentioned in the brochure, excerpts from the Seventh Social Code (SGB VII), the Occupational Health and Safety Act (ArbSchG), the Administrative Enforcement Act (VwVG) and the Administrative Offences Act (OwiG) can be read directly in the appendix. This brochure also contains a sample confirmation of the transfer of employer obligations in the appendix, which can be completed and used as required. The legal consequences of violations of occupational health and safety regulations and accident prevention regulations are summarised clearly and in detail at the end of this brochure as a leaflet. The Accident Insurance Modernisation Act (UVMG) includes changes to the Seventh Book of the German Social Code (SGB VII). The changes to SGB VII essentially relate to the core areas of organisation of the accident insurance institutions, responsibility law, property law, burden sharing and company audits. There have been no significant changes with regard to the obligations of employers in occupational health and safety. However, the change in the law does bring a few important improvements for employers. As accident insurance and occupational health and safety authorities are to coordinate more closely in future when providing advice and supervision, double inspections - i.e. visits by different prevention services in quick succession - will be avoided. The closer dovetailing of accident insurance regulations with state occupational health and safety legislation will help to reduce bureaucracy. Since 2003, the number of accident prevention regulations has fallen by more than half.
