This brochure describes the obligations of entrepreneurs, the responsibility for fulfilling these obligations, the transfer of entrepreneurial duties, and the consequences of non-compliance with these obligations. To shorten the tedious search for the legal texts mentioned in the brochure, excerpts from the Seventh Social Code, the Occupational Safety Act, the Administrative Enforcement Act, and the Administrative Offenses Act can be directly read in the appendix. Also included in the appendix is a template for the confirmation of the transfer of entrepreneurial duties, which can be filled out and used if necessary. The legal consequences of violations of occupational safety regulations and accident prevention regulations are summarized at the end of this brochure in a clear and detailed fold-out format. The Modernization of Accident Insurance Act includes, among other things, changes in the area of the Seventh Book of the Social Code. The changes to SGB VII primarily relate to the core areas of the organization of accident insurance providers, jurisdiction, property law, burden distribution, and operational audits. In terms of the obligations of entrepreneurs in occupational safety, there have been no significant changes. However, the legislative amendment brings some important improvements for entrepreneurs. As accident insurance and occupational safety authorities are to coordinate more closely in the future regarding advice and supervision, duplicate inspections, meaning closely timed visits from various prevention services, will be avoided. The closer integration of the regulations of accident insurance with state occupational safety law contributes to reducing bureaucracy. Since 2003, the number of accident prevention regulations has decreased by more than half.
