The aim of this work is to investigate the regulatory legitimacy of municipal electricity, gas, and district heating supply, as well as the promotion of decentralized energy supply technologies. Initially, it will be examined whether and to what extent the main energy policy objectives—affordability, security, and environmental compatibility—can be achieved through such state actions. To substantiate the discussion economically, the findings of modern institutional economics will be applied to municipal energy supply. Subsequently, the work addresses the regulatory conformity of municipalization and decentralization, focusing on the impact on competitive freedom.
