The present new edition of the Bernese Commentary deals with the general provisions on the statute of limitations for private law claims (Articles 127–142 of the Swiss Code of Obligations). Swiss statute of limitations law has changed significantly since the publication of the previous Bernese Commentary by Hermann Becker (1945), which is why the commentary has been completely rewritten.
As of January 1, 2020, Swiss statute of limitations law has come into effect in revised form. In addition to the changes brought about by the revision, new developments in doctrine and case law are also examined. The aim of this Bernese Commentary is to provide a dogmatically grounded presentation of the statute of limitations law, offering solutions to current and future issues for research and legal practice. The commentary is based on the systematic arrangement of the statutory regulations.
