The author examines to what extent the power position of platform operators of social networks can, or must, be responded to with a limitation of private autonomy. Platform operators now hold a special power position in the public opinion-forming process by determining this through the moderation of user content according to their general terms and conditions. Following a comprehensive analysis of the relevant national and European regulations, particularly the DSA, as well as decisions from various courts and a legal comparison to the British Online Services Act, the author develops procedural and substantive guidelines for content moderation de lege ferenda.
