Täter-Opfer-Ausgleich und strafrechtliche Mediation

The legal framework for conducting victim-offender mediation - a form of restorative justice - is very favorable in Germany. Unfortunately, to this day, far too little is made of these legally anchored opportunities. The Venice Declaration of the Justice Ministers of the Council of Europe specifically emphasized that restorative justice should not only be a tool for dealing with crimes but rather a culture that permeates the entire justice system. This guide aims to contribute to ensuring that judges and prosecutors refer more cases for mediation in criminal matters to the appropriate authorities.
