Motivation der Richter für die Verhängung von Hausarrest

In accordance with the provisions of the Constitution of the Republic of Ecuador and the international conventions ratified by the Ecuadorian State, criminal judges, in the exercise of their duties, apply the precautionary measure of house arrest in favor of individuals who are in a vulnerable state or require special attention due to their condition. This lack of regulations has led to criminal proceedings being unpunished, both publicly and privately, because defendants, aware of the insecurity in their homes and seeing the possibility of evading justice, flee or do not comply with this movement restriction. The aim of this study is to identify the legal, technical, and judicial reasons that judges rely on for criminal guarantees in their decisions regarding the application of the precautionary measure of house arrest.
