In the late 1990s, the number of pensions paid by disability insurance to people suffering from somatoform dolorous disorder or a comparable pathology, such as fibromyalgia or post-traumatic stress syndrome, increased significantly. This increase has led legal professionals, particularly the Federal Tribunal, to devise new solutions to address the very complex legal and medical cases of these insured individuals.
This study focuses on the "non-objective" interests at stake. It offers a critical analysis of this subject while maintaining a practical approach. The study is structured around three main axes, divided into four parts: the definition of non-objective attenuation from a medical and legal perspective (first part), the recognition over time, through social security law, of this category of problems (second part), and finally, the material and formal conditions for compensating the negative effects of these pathologies on the health of insured individuals (third and fourth parts).
