Künstliche Intelligenz als Erfinder im Sinne des Patentrechts

Patent law is confronted with novel questions that were unimaginable at the time of its conception. AI is capable of solving problems with considerable autonomy. This study discusses, presenting doctrine, practice, and case law, whether an AI can make an invention in both a technical and legal sense. Following this, it analyzes whether and to what extent an AI can fulfill the patent law definition of an inventor under current law (de lege lata) and proposed law (de lege ferenda).
