Kostenverteilung und Haftung für Beiträge im Stockwerkeigentum

A large number of multi-family buildings are in need of renovation and are on the verge of a major cyclical renewal. Financing such renovations poses significant challenges for a homeowners' association. This dissertation comprehensively addresses the justification and distribution of communal costs as well as liability for contributions in both internal and external relationships. It analyzes the distinction between individual and communal costs and the design of cost distribution keys. Additionally, practical questions are discussed, particularly regarding cost distribution in cases of special usage rights and sub-communities, as well as the implications of Article 712h, paragraph 3 of the Swiss Civil Code. The dissertation serves as a guide for courts, lawyers, notaries, and property managers in this contentious area.
