Kooperative Risikovorsorge

The state risk provision highlights the governance weaknesses of the law to a significant extent. The legislator promises comprehensive security but is unable to establish standards for the provision itself and delegates this responsibility to regulatory authorities that are weakly legitimized democratically. These authorities tend to extend the level of protection beyond the optimal level and prefer to use directly controlling instruments, despite the recognized advantages of decentralized and autonomous regulatory structures. The potential gains in effectiveness and efficiency achievable through cooperative provision remain largely untapped today. This book addresses legislative techniques and enforcement under uncertainty and is aimed at enforcement and judicial authorities, state chanceries, parliamentary services, and legal scholars.
