The law on administrative jurisdiction of the Canton of Bern has been significantly amended since its enactment in 1990. Since 2009, the guarantee of legal recourse and the revised federal administrative law have been implemented, and the unified complaint has replaced the previous administrative and municipal complaints. This presents new application issues. The newly published commentary aims to outline the fundamentals of Bernese administrative and constitutional law based on cantonal and federal court rulings, following the proven concept of the work by Merkli/Aeschlimann/Herzog (1997). The procedural guarantees of the European Convention on Human Rights (ECHR) and the Federal Constitution (BV) are taken into account, as well as parallel federal regulations, namely the Federal Supreme Court Act (BGG), the Federal Act on Administrative Procedure (VwVG), and the Federal Act on Social Insurance (ATSG), along with the partially applicable Code of Civil Procedure (ZPO) and the procedural rules of the laws on political rights of the Canton and the Federation (PRG and BPR). The apparatus now includes a subject index in French.
