This commentary was last published in its 2nd edition in 1996. Since then, legislation regarding employment contracts has undergone numerous changes. At the same time, labor law jurisprudence and literature have significantly expanded. All of this necessitated a complete revision of the work. The focus of the commentary remains on the presentation and evaluation of case law. It is intended primarily as a practical working tool for labor law practitioners, but it is equally written for both legal professionals and non-lawyers. The use is facilitated by a comprehensive subject index and especially by continuous keywords in the margins of the commentary text.
Regarding the new edition: The 3rd edition is based on the state of legislation as of 2014, incorporating not only the Code of Obligations regarding employment contracts but also other laws of labor law significance (Labor Law, Equality Law, Data Protection Law, Social Security Legislation, particularly regarding occupational pensions) into the commentary. The recent legislative revisions that came into effect on January 1, 2014, concerning business transfers in insolvency, social plan obligations, and compensation for managers have been integrated into the commentary. Another focus of the revision is the labor law process following the repeal of Article 343 of the Code of Obligations, based on the new Civil Procedure Code that came into effect on January 1, 2011. The relevant case law from the cantonal courts and the Federal Supreme Court, specifically the judgments published in the JAR and ARV as well as in the official collection of Federal Supreme Court decisions, have been reviewed up to 2014. The literature has also been considered up to 2014, with the discussion primarily focusing on standard labor law literature; monographs and articles are cited only in exceptional cases.
