Kelsen:Hans Kelsen works

Volume 7 of the HKW comprises four writings from the final years of the formation phase of Reine Rechtslehre. They document Kelsen's wide range of interests and activities, both in disciplinary and regional terms. In addition to the (second) report on Austria's constitutional situation in the Jahrbuch für Öffentliches Recht, the volume contains Kelsen's search for a position with regard to central sociological, (social) psychological and theological approaches to interpretation. As the subtitle of the groundbreaking monograph Der soziologische und der juristische Staatsbegriff (The Sociological and Legal Concept of the State) states, the aim is always to "critically analyse the relationship between the state and the law". The debate with Sigmund Freud's theory of the masses and the parallels between God and the state or theology and (constitutional) jurisprudence are part of further controversies.
