In the current competitive environment of outpatient healthcare provision, several statutory health insurance companies are facing the risk of insolvency. In response, the legislator has taken measures in the Act on the Further Development of Organizational Structures in Statutory Health Insurance; it provides for the possibility of insolvency, which could lead to their closure. At the same time, it regulates liability. However, whether this actually represents an advancement of the structures of statutory health insurance—considering competitive aspects and in the context of community law—is a matter of debate within the professional community. This volume addresses the consequences of legislative intervention and the options for action.
