This book addresses the issue of capacity withholding in the wholesale electricity market. Electricity producers can exert market power in the wholesale market by either withholding generation capacities or setting prices above competitive levels to achieve a higher market price and thereby increase their revenues. After a comprehensive explanation of the practices of capacity withholding and the issues arising in a competition law context, the book analyzes whether an increased degree of transparency, as provided for in REMIT and Regulation 543/2013, could facilitate the efficient functioning of wholesale electricity markets and the investigation of capacity withholding. Additionally, it examines how the prohibition of market manipulation, as outlined in REMIT, affects the handling of abusive practices related to capacity withholding in the wholesale electricity market.
