Felix Aiwanger comprehensively addresses the phenomenon of asset protection – the unilateral shielding of personal wealth against liability claims. He guides readers through a world where liability is at the debtor's disposal, where advisors engage in business, and where states compete for liability-unfriendly legislation, all on multiple narrative levels. The focus is particularly on 43 offshore jurisdictions and 24 U.S. states, whose regulations are systematically compared. The author develops concrete solutions to 15 specific problems for which legal systems have not yet provided adequate answers. He offers insights in the areas of contract law, foundation law, creditor challenges, enforcement law, and private international law. This work was awarded the Lieselotte-Pongratz Doctoral Prize 2024 by the Study Foundation.
