In the age of digitalization, the Internet has long since reached all levels of government activity. In the area of criminal law and criminal procedure, this has led in recent years not only to a new digital space for criminal activity, but also to another tool for law enforcement agencies. In this book, Simona Künzli for the first time comprehensively examines the legal implications of one of these tools: the Internet search. In doing so, she not only sheds light on its legal prerequisites, but also, based on numerous examples from legal practice, on the difficulties and dangers associated with Internet searches at the interface of civil liberties, procedural guarantees, and public law enforcement interests. Finally, it presents a legislative proposal that takes up the still unresolved problems and inserts them into the dogmatics of the Code of Criminal Procedure. The book is primarily aimed at experts entrusted with Internet investigations. However, it should also serve as a basis and impulse for a political discourse.
