The Basler Commentary on International Criminal Law is the first German-language commentary on the Mutual Legal Assistance Act (IRSG) and the Money Laundering Convention (GwÜ). Like all Basler commentaries, it is primarily tailored to the needs of practitioners. Its regular publication will make it a helpful guide in a constantly changing legal work environment.
The appendix consists of a reproduction of the relevant additional legal bases and conventions, including the Mutual Legal Assistance Ordinance (IRSV), the European Convention on Mutual Assistance in Criminal Matters (EÜR), the Schengen Implementation Convention (SDÜ), the European Extradition Convention (EAÜ), as well as the Convention of March 21, 1983, on the Transfer of Sentenced Persons (ÜÜVP) and the treaty between the Swiss Confederation and the United States of America on Mutual Legal Assistance in Criminal Matters (RV-US).
The Basler Commentary "International Criminal Law" provides an introduction to the complex subject of international mutual legal assistance in criminal matters and comprehensively comments on the Mutual Legal Assistance Act (IRSG) of March 20, 1981, as well as the Council of Europe Convention on Money Laundering and the Investigation, Seizure, and Confiscation of Proceeds from Crime (Money Laundering Convention, GwÜ) of November 8, 1990.
The volume takes into account the relevant provisions for Switzerland according to (other) international treaty law, such as the European Convention on Mutual Assistance in Criminal Matters (EÜR) and the Schengen Implementation Convention (SDÜ) in the context of European mutual legal assistance; the European Extradition Convention (EAÜ) in the context of European extradition; and the Convention of March 21, 1983, on the Transfer of Sentenced Persons (ÜÜVP) in the area of substitute criminal prosecution. In addition to the relevant case law of the Federal Criminal Court and the Federal Court, the associated practice is also addressed.
