In Switzerland, the last few years have seen the practice regarding loyalties undergo a curious exercise of grand écart: as the loyalties of the market increased, the jurisprudence reduced them in proportions disconnected from reality. This work does not merely react to this unsatisfactory situation. It aims to analyze in detail the evolution of the law of loyalties in Switzerland since the beginning of the 20th century. Adhering closely to the legislator's intent, it proposes an innovative and objective method for determining rent, redefining the concept of yield at the heart of the issues. This contribution seeks to remove the question of rents from political debate.
