Even the most precise knowledge of legal texts is not sufficient for legal work. The inevitable distance between a specific case on one hand and generally abstract norms on the other makes interpretation essential. This often requires a methodical approach that can be quite elaborate. This will be discussed here. The focus is on the interpretation of legal norms, working with (potentially) incomplete or excessive regulations, and dealing with precedents, meaning prior case law related to the newly posed legal question. The particularities of EU law-compliant legal reasoning, including its limitations, will also be addressed in detail. The book is aimed at students of law as well as practicing legal professionals.
