Due to advancing globalization, insolvencies are no longer confined to the national level but occur across borders. This is particularly true for insolvencies of larger companies with locations in various countries. The handling of cross-border insolvency proceedings often presents significant practical challenges and complex legal questions for the parties involved, such as which law applies to specific issues and processes. The provisions of the EuInsVO take precedence over national regulations in application. This commentary thus provides all the necessary explanations for the practical structuring of cross-border insolvency proceedings and serves as a reliable guide for insolvency law practice. It considers relevant domestic and foreign case law and literature on the EuInsVO as well as the latest domestic and foreign literature on the new version. The work aims to contribute to and influence the scientific discussion.
