The cornerstone of the market economy is the property right to the means of production, which forms the core of the national and supranational constitutional order of the EU. However, this core does not include the protection of dependent labor, which represents the functional guarantee of the European market economy. For this reason, the European Constitution deepens the national welfare state principle: it enshrines the principle of a sustainable welfare state. It also specifies this through social law on co-determination. Furthermore, the EU proves to be a global actor: it counters the unrestricted world market economy with a social world market economy.
