DNA analysis in criminal proceedings

The forensic medical possibilities for identifying the perpetrator have developed rapidly in recent years, especially in the field of DNA analysis. This raises a number of questions of criminal procedural and constitutional law, for example regarding the permissibility of creating genetic phantom images and the information gained from an analysis of the non-coding region of DNA. The legislator has recognised the need for action in this area; at the very least - according to the coalition agreement for the 18th legislative period - the usability of so-called near misses should be regulated by law. This will be taken as an opportunity to subject the lex lata to an overall revision in the light of new research findings and to submit a reform proposal for the 81e h Code of Criminal Procedure.
