DiKE Wie viel Bluntschli steckt in Huber?

The private law code developed by Johann Caspar Bluntschli (1808–1881) for the Canton of Zurich in 1854/56 is considered the most important template for the Swiss Civil Code designed by Eugen Huber (1849–1923). This view remains widely held to this day. But how much of Bluntschli is truly reflected in Huber? This question is addressed in the present book concerning inheritance law, as both Bluntschli and Huber had a particular interest in inheritance law and its significant impact on society. The focus of the investigation is on the fundamental design decisions—namely, the justification for inheritance law, whether the statutory or the testamentary succession should primarily apply, and how the state's inheritance law should be handled—of Messrs. Bluntschli and Huber in inheritance law. The study shows that they indeed shared certain views. However, it also demonstrates that the differences between the ideas of the two jurists on key points are greater than previously assumed.
