Product details

The Private Law Code for the Canton of Zurich of 1854/56, drafted by Johann Caspar Bluntschli (1808-1881), was the most important template for the Swiss Civil Code drafted by Eugen Huber (1849-1923). This view is still widely held today. But how much Bluntschli is really in Huber? This question is answered in this book with regard to the law of succession, because both Bluntschli and Huber were particularly interested in the law of succession and its importance for society, which should hardly be underestimated. The study focuses on the fundamental design decisions - i.e., the rationale for the law of succession, whether primarily the legal or the voluntary succession should apply, and how the state's law of succession should be handled - of Messrs. Bluntschli and Huber in the law of succession. The study shows that they certainly shared certain views. However, it also proves that the differences between the ideas of the two jurists on the central points are greater than was previously assumed.
