Although distribution law is of great importance in everyday business life, it receives relatively little treatment in Swiss legal doctrine and case law, in contrast to the EU area. Practitioners are therefore regularly confronted with the fact that, in their daily work with a background in distribution law, they do not have the usual access to standard works. This situation is to be remedied at least in part by the present publication. The book provides an overview of the legal foundations and problems of Swiss distribution law and is aimed equally at lawyers and attorneys as well as other persons involved in distribution law. It is neither a commentary nor a textbook, but a presentation and treatment of the issues that arise in practice. The authors are all practitioners in the field of distribution law. The structure of the publication is based on that of a practical distribution agreement and is thus intended to reflect a chronology of distribution law. In view of the practical significance of these forms of contract, the agency, exclusive distribution and franchise contracts are dealt with in each case - insofar as the topic warrants separate treatment at all. At the end of individual chapters, a checklist is also provided, which covers the relevant points of a chapter for the respective author and is intended to serve as a control instrument for the practitioner when drafting a distribution agreement.
