Since 2003, companies in Switzerland can be defendants in criminal proceedings and can also be subject to criminal sanctions. Such criminal proceedings often receive public attention, but they sometimes face criticism. Since the introduction of the sanctions framework for companies, there have been no significant changes. This work examines the purposes of sanctioning companies and to what extent the current corporate criminal law meets these purposes. In the context of sanctions, the possibilities for resolving proceedings play a crucial role. Therefore, these are also scrutinized, and deficiencies are identified. Jan Wenk analyzes the current legal situation in the area of corporate sanctions and criminal procedure law and presents concrete reform proposals.
