DiKE Rechtsbehelfe bei Verständigungen

This work deals with the possibilities of reviewing plea agreements in criminal proceedings. First, the basic provisions of the Verständigungsgesetz are presented and an assessment of violations of the Verständigungsgesetz is made. Based on this, the review of unlawful plea bargains is put to the test, whereby the study, taking into account current review and constitutional jurisprudence, comes to the conclusion that the remedy of review de lege lata is only able to curb unlawful procedural practice to a limited extent. Furthermore, the work examines the possibilities of reviewing judgments based on the right of notification on the basis of the grounds for review in §§ 359 No. 3, 362 No. 3 of the Code of Criminal Procedure and comments in depth on fundamental questions of the right of review. The study ends with concrete proposals for normative adjustments at the level of criminal procedure.
